Who you are dealing with
Daytakt is a store operated by Atlantic E-Commerce ("Daytakt", "we", "us", "our"), a company registered in the State of Wyoming, United States. We run this website, the store and everything on it — content, tools, products and services (the "Services"). The store is powered by Shopify.
These Terms, together with our Privacy Policy, Refund & Return Policy and Shipping Policy, set out your rights and ours. By using the Services you agree to them. If you do not agree, please do not use the Services.
1. Access and account
By using the Services you confirm that you are at least the age of majority where you live. If you create an account, keep your details accurate and your password to yourself; you are responsible for what happens under your account. Accounts may not be sold, transferred or licensed.
2. Our products
We photograph every object ourselves and describe it as accurately as we can. Colours can still look different on a different screen. Descriptions, images, availability and prices may change without notice, and we may limit quantities, decline an order or stop selling something at any time.
3. Orders and fulfilment
- Offer and acceptance. Your order is an offer to buy. We accept it when we send an order confirmation or dispatch the goods, and we may decline an order at our discretion.
- How your order reaches you. Objects are shipped by us or by our fulfilment partners, sometimes in more than one parcel with separate tracking. If something becomes unavailable after you have ordered, we will tell you and either refund you or offer an alternative — the choice is yours.
- Changes and cancellations. We start work quickly. Email hello@daytakt.com as soon as you can: before dispatch we can cancel and refund in full; after dispatch it becomes a return.
- Fraud checks. Orders may be verified, and we may cancel one we believe to be fraudulent.
- Personal use. What you buy here is for your own use, not for resale.
Returns are governed by our Refund & Return Policy; delivery by our Shipping Policy.
4. Prices, taxes and payment
Prices and promotions can change without notice. The price you pay is the one shown when you order, and it appears in your confirmation email. Prices exclude sales tax, which is calculated and shown at checkout where it applies. Standard shipping within the United States is free.
You agree to give accurate payment details and authorise us, and our payment processors, to charge your chosen method for the order total and any applicable tax.
5. Delivery and risk
- Estimates. Delivery windows are estimates, not guarantees. Carriers, weather, volume and customs can all delay a parcel.
- Risk. Risk passes to you when the carrier delivers the parcel. If a parcel is marked delivered and you do not have it, tell us within 7 days of that scan and we will open a carrier claim and see it through.
- Addresses. If the address you give is wrong or incomplete, a second delivery attempt is payable by you.
- Split shipments. Objects in one order may travel separately, at no extra cost.
6. Intellectual property
The text, photographs, graphics and design of this site are ours or our licensors', and are protected by law. Our photographs in particular are made for this shop and are not stock. You may use the Services for your own personal, non-commercial purposes; nothing here grants any other licence.
"Daytakt" and our marks and designs belong to us. Shopify's marks belong to Shopify. Please do not use either without written permission.
7. Third-party tools and links
We sometimes link to, or give access to, tools and sites we do not run. They come as they are, and what you do there is governed by their terms, not ours.
8. Reviews and feedback
If you send us a review, an idea or any other feedback, you grant us a perpetual, worldwide, royalty-free licence to use and display it. You confirm it is yours to give. We may moderate or remove it.
Disclosure: if you received anything — a discount, a free product — in exchange for a review, say so in the review. Advertising rules require it, and so do we.
9. Shopify
This store runs on Shopify, but your purchase is with Atlantic E-Commerce. Shopify is not responsible for your transaction with us.
10. Errors
Occasionally something on the site may be wrong — a price, a specification, a delivery estimate. We may correct it, and may cancel an order placed on the strength of an error, at any time and without prior notice. If we cancel, you are refunded in full.
11. Acceptable use
Do not use the Services to break the law, infringe anyone's rights, harass anyone, distribute malware, scrape the site, send spam, or get around its security. We may suspend or end access for any of that.
12. Termination
We may suspend or end your access at any time. The sections that are meant to survive — intellectual property, feedback, disclaimers, limitation of liability, indemnity, severability, waiver, assignment and governing law — continue to apply afterwards.
13. Disclaimer of warranties
Except where we say otherwise in writing, the Services and the products are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted or error-free. Some jurisdictions do not permit some of these exclusions; where that is so, they apply only as far as the law allows.
14. Limitation of liability
To the fullest extent the law permits, neither Daytakt nor Shopify nor our respective officers, employees, agents, affiliates, contractors, service providers or licensors will be liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, revenue or data, arising from your use of the Services or the products — even if we were told such damage was possible. Our total liability for any claim will not exceed what you paid for the product the claim is about.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
15. Indemnity
You agree to indemnify and hold harmless Daytakt, Shopify and our affiliates and people from claims, losses, liabilities and reasonable costs arising out of your breach of these Terms, your breach of the law, or your misuse of the Services.
16. Events outside our control
We are not liable for a delay or failure caused by something beyond our reasonable control — acts of God, labour disputes, shortages, epidemics, war, terrorism, government action, utility failures or carrier disruption.
17. Severability, waiver, entire agreement
If any part of these Terms is unenforceable, it is enforced as far as it can be and otherwise severed; the rest stands. Not enforcing a right once does not waive it. These Terms and the policies they reference are the whole agreement between us and replace anything said before.
18. Assignment
You may not assign these Terms without our written consent. We may assign or transfer our rights and obligations without notice.
19. Governing law
These Terms, and any dispute arising from them, are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts sitting in Wyoming. Nothing here removes a right you have to bring proceedings in the courts of the country where you live, where consumer law gives you that right.
20. Changes
The current version of these Terms is always on this page. When we change them we post the new version with a new "last updated" date, and give notice where the law requires. Continuing to use the Services after a change means you accept it.
